La Comisión de Derechos Humanos de las Naciones Unidas define el asilo como una forma de protección que permite a una persona permanecer en los Estados Unidos en lugar de ser expulsada (deportada) a un país donde teme persecución o daño. Según la ley estadounidense, las personas que huyen de sus países porque temen ser perseguidos pueden solicitar asilo. Si se les concede asilo, esto les da protección y derecho a permanecer en Estados Unidos. A quienes se les concede asilo se les llama asilados.

Según la ley de inmigración de los Estados Unidos, un refugiado es alguien que ha sido reasentado en los Estados Unidos a través del programa de reasentamiento de los Estados Unidos. La persecución puede ser daño o amenazas de daño a usted o su familia o personas similares a usted. Una persona también puede obtener asilo si ha sufrido persecución en su país en el pasado.

Sólo puede obtener asilo si al menos una de las razones por las que alguien le hizo daño o podría hacerle daño es por su raza, religión, nacionalidad, opinión política (o una opinión política que alguien cree que tiene), o el hecho de que usted es parte de una “grupo social determinado”.
